The defense was ready to rest.
Then came, Mrs Kari T Morrissey, prosecutor in the Alec Baldwin trial, who absolutely wanted to appear as a witness to clear her name.
The judge even explained to Kari that she was not required to be a witness and was trying the best way she could to tell her that. Because she knew that Kari was about to shoot herself in the foot, especially since the trial was made public. She even repeated herself several times by telling her that no one was requiring her to testify.
Kari said that the information pertaining to her, needed to come out in the public…she should not have testified. Sank her own boat by doing so. She thought that by being a witness on the stand she could explain her way out of her wrongdoing which backfired on her.
Here is a resume of her testimony. During her investigation she “came to understand ” that there was a large batch of live ammunition that was in the possession of Thell Reed (Hannah’s father) A portion of that batch of ammunition that belonged to Thell was taken by Thell Reed and Seth Kenny to the 1883 Cowboy training camp. When it was over, the leftover ammunition was taken back to PDQ Arm & props. (Company owned by Seth Kenny) Seth Kenny took some of the ammunition from that container (That he had brought back from Texas) and turned it into the sheriff’s department. According to Kari, he did so by trying to exonerate himself. They took the ammunition and tagged it into evidence under the rust case. Law enforcement then executed a search warrant at PDQ props and took the entire container. Portions of that ammunition were sent to the FBI for testing so that they could compare the live rounds that were found on a set of rust. The FBI testing demonstrated that the live rounds that were taken from PDQ props, that were originally in Texas, did not match the live rounds on the set of rust.
According to Mrs Kari, apparently the evidence indicated that the ammunition never left Arizona. Mr Jason Bowles put Mr Troy Teske on the witness list and wanted to call him on the stand. Mrs Kari conducted a pre-trial interview with Mr Teske. At that point, she had some understanding that Mr Teske had contact with law enforcement regarding the live rounds that he still had in Arizona. These rounds never left Arizona, they were in the possession of Thell Reed, and Troy Teske. They never went to Texas and never came to New mexico. That is what the evidence indicated.
Mrs Hancock was in communication with Mr Teske, about trying to get those rounds but was unable to. Mrs Kari did not find that concerning because those rounds had never left Arizona and the filming of Rust was in New mexico. The rounds taken from PDQ went from Arizona, to Texas, to Albuquerque (New Mexico). All this according to Kari did not strike her as being of significant value. Mrs Kari being an expert in ammunition and all, was able to conclude that the ammunition were visibly dissimilar to the rounds on the set of rust.
Fast forward to November 2023, Mr Tuske mentioned that he was still in possession of these live rounds that were Thell Reeds live rounds that had never left the state of Arizona, according to Mrs Kari. Mrs Kari said that Mr Tuske indicated that the ammunition were from the same batch that was sourced from Joe Swanson, and Mrs Kari told him that she should get those from him. She then had a conversation with detective Hancock, after the pre-trial interview, about how they could get the rounds from Mr Tuske, and send a local enforcement agency to pick them up.
She then took it upon herself to figure out if that was necessary, since they never left Arizona, and it was her impression that they did not match the live rounds from the set of rust. You know, being an expert and all.
She then reached out to Mr Jason Bowles to see whether or not the rounds should be tested by the FBI. She then asked Mr Bowles to send her a photograph from the rounds from Troy Teske so that she could see if they were even remotely similar, so that she could then get in touch with law enforcement to collect the ammo from Mr Tuske. She did not want to do that if they didn’t look anything like the rounds from the set of rust. Because all six rounds from the set of rust were identical to each other.
She then got the photo from Mr Troy Tuske, so she could compare the ammunition to the ones from the set of rust, starting again in her defense, that they never left the state of Arizona. The only way that it would be relevant to the investigation of the set of rust is if they had any similarity to the live rounds that were found on the set of rust…. You know because they had a ton of dummies, live rounds on the set, stored everywhere, all over the place. Because they were trying to figure out the source of the live rounds. Which is what everyone was still trying to figure out during Hannah’s trial. Still nobody had solid evidence of where they came from except from Mrs Kari. IF they were similar, according to expert Kari, then she could go through the process of connecting the right people to get the ammo from Mr Tuske. But she didn’t bother doing so because she is an expert and did not want to bother if they did not look anything alike. Because all 6 rounds from the set of rust are identical to each other.
When Mr kari got the photo from Mr Teske, she could immediately tell that they were very dissimilar to the live rounds found on the set of rust. You know, because Mrs Kari became an ammunition expert during the Hannah trial. According to Mrs Kari the ammunition expert, the ammunition in Mr Tuske possession have brass primers and not silver (unlike the ones from the rust set, (trying to sound like an ammunition expert here). Then she continued on to appear as an ammunition expert, mentioning that one of the ammunition appears to have a Starline brass casing, but that they have truncated cone projectiles. She had seen ammunition that looked exactly like that, almost, collected from the sheriff department, that went to the FBI for testing, and was determined to not be similar in any way, to the live rounds from the set of rust. So Mrs Kari took it upon herself to not take any steps to collect the rounds from Mr Tuske because they were in Arizona… had never come to New Mexico and did not match to the live rounds from the set of rust.
Mr Teske was then called to New Mexico by Mr Bowles to testify at Hannah’s trial, and bring samples of the ammunition. Mr Tuske then brought samples of the ammunition to show them to Mr Bowles and according to Mr Kari Mr Bowles said that he didn’t want them, and was not going to use them, and told him that he was not going to call him as a witness. Mr Tuske sat in court during the trial, and at some point, contacted the deputy downstairs to tell them that he had the ammunition, then tried to get a hold of detective Hancock who was not available because she was busy with Kari…
When Mr Teske showed up with the ammunition that Mr Bowles told him to bring to the state of new mexico, he was not called as a witness, Mr Bowles was not going to take the ammunition from him.
Then Mr kari thinks she has a jaw dropping moment that will save her, and make what she did ok. The photographs from Hannah’s phone extraction show a spot on match for the live rounds found on the set of rust. Apparently this is why Mr Bowles told Mr Teske to get out of there, because according to Kari, it would not have hurt the case against Hannah…
So Mr Spiro then proceed to ask Mr kari a couple of questions;
A few assistants and attorneys working for Mrs Kari left the case at her request…yes her request. They did not resign at all. (Sarcasm)
Kari Has excuses for not turning over the report that Mrs Hancock created of the ammunition that Mr Tuske dropped. She didn’t allow Alec Baldwin’s defense to view the evidence at any point during the defense’s request to review evidence in the case.
Mrs Kari then proceeds to proudly explain that the ammunition is the best evidence against Hannah. (Yes we all know that you really don’t like her. In fact, does she even like anyone at all ?)
Mr Spiro then proceeded to tell Mr Kari that she didn’t like Mr Baldwin very much. To which she responded that it was absolutely untrue. She appreciates his movies, his acting on Saturday night live and his politics.
Mr Sipro then tell her that one of the witnesses, who disagreed with her during an interview, said that she thought Alec was a (insert expletive)
Mrs Kari of course does not recall saying that. She knew that it was something that Mr Baldwin would say on the set of rust…. Yes of course Mrs kari, that makes perfect sense.
Asked of she denied that under oath:
Mrs kari hesitated a lot, before responding, that without having more information she does not recall ever saying that … .hmm ? What information ? It’s not that hard, either you said it, or you didn’t. I guess being a prosecutor, you get used to lying and well, she is really good at her job, isn’t she ?
Q: Did you call him an arrogant (expletive) to another witness?
Mrs Kari : To who ? What witness ?
Q: Did you call him arrogant (expletive) during a witness interview?
Mrs kari : I don’t believe I did, I don’t recall.
Q: You deny it ?
Mrs Kari : Without knowing what you are talking about ? All I can tell you is that I can’t respond if I don’t know what you are talking about. (Expert at beating around the bush)
Q: You also said to a witness that you were going to teach him a lesson?
Mrs Kari : I never said to a witness that I would teach him a lesson. Absolutely not, in fact Mr spiro, I want to give a full response to your question. I made every effort in this case to resolve this case with your client in a very favorable way for him …
Strikes the rest of the response as non responsive, said Mr Spiro.
Mr spiro had no more questions, then gave Mrs kari an absolutely disgusted look, after returning to his seat.
Without being invited or asked to :
Mrs Kari continued : All I want to say, I have no recollection of calling him any of those names. I have invited the defendant to tell me what he is talking about and he has declined. (Well duh, I would if someone called me all of those names!) I want the court to take notice of that.
Alec Baldwin’s case got dismissed with prejudice ! The judge established a Brady Violation.
In general, a “Brady violation” occurs when a prosecutor fails to provide a defendant or criminal defense attorneys with any favorable or helpful evidence to a defendant’s case.
Oh I loved Honorable Mary Marlowe Sommer words.
The Sante Fe County Sheriff Office and the prosecution failed to disclose the supplement report to defense and provide defense the opportunity to inspect the rounds collected into evidence that Mr Teske gave. Hancock’s testimony failed to connect the evidence to the instant case, the case agent as well as pursuant to Hancock testimony miss Morrisey was aware of the new evidence and yet did not make an effort to disclose it to the defense. The state’s willful withholding of this information was intentional and deliberate of this conduct does not rise to the level of bad faith it certainly comes so near to bad faith as to show signs of scorching prejudice when discovery has been produced.
I remember while watching Hannah’s trial that Seth Kenny and Sarah Zachary were desperately trying to sabotage Hannah. I had the impression that Sarah really hated Hannah and maybe allegedly tried to get her fired, by loading a live bullet into the gun while the gun was left unattended on the cart, but never expected it to kill someone ? All in all, that place was an absolute mess with life, dummies all over, not even secured. Obviously some lives and dummies were mixed together. Now, who is really at fault ?
Seth Kenny for not properly keeping all of his ammunition on the set, secured and in order ? Hannah mixing them by mistake, though I highly doubt she would do something like that, or the prop master that maybe tried to sabotage her ? Hannah had really good experience from her father and made me think that chances to mix the ammunition, live and dummies, would be very slim. She did check the gun and unfortunately, left it on the cart, unattended for a while. Before handing it to Alec while they were about to shoot the church scene, she should have checked it again, but she probably didn’t think that maybe someone would try to jeopardize things. If everyone was in a rush on the set, I guess it would be easy to make a mistake with a live and dummy as apparently, they looked similar, especially while in the gun chamber.
Marissa Poppell’ over what Mr Spiro suggested, were shoddy and subpar searches, for the live ammunition that ended up in the actor’s revolver and killed cinematographer Halyna Hutchins. Her arrogant, smug look on the stand was enough to drive me crazy. Hopefully she loses her job over the poor quality of the work she did. That sheriff’s department has a few bad apples that need to be fired for their incompetence and corruption. It is disgusting that these things still happen. Had she done thorough research, the possibility of finding the live bullet that hit Halyna would have been greater.
What are your thought ?
